Uncontested Divorce
Divorce in Pennsylvania can be classified as "fault" or "no-fault." A typical no fault or uncontested divorce does not require any evaluation of who did what to whom. If both parties agree, there is a 90 day waiting period after the case is started before the consents of the parties can be filed. One party can also obtain a no fault divorce without the other spouse's consent if the parties have been separate and apart for at least two years. To obtain the divorce itself neither party will testify on the question of marital fault. However, issues of property division, custody, child and spousal support, alimony pendente lite and alimony may remain in dispute and require resolution either through negotiation or court proceedings. If these issues are not present or are worked out by the parties, our attorneys will facilitate the legal paperwork necessary to protect the agreement of the parties and/or process the final divorce.
Contested Divorce
Absent mutual consent for entry of a divorce decree or the parties having been separated for at least two years, grounds for the divorce itself can be contested. In these circumstances, a proving of marital "fault" is necessary to establish entitlement to a divorce. Grounds for a fault divorce include abandonment or desertion, adultery, abuse, indignities and others. Naturally, issues of property division, child and spousal support, custody, and alimony may also be in dispute and require careful analysis and advocacy.
