Working with Couples Who Can Work Together
After a divorce has been finalized and all of the battles are over, it is often the anger and pain of the situation that stays with the former spouses. Instead of the sense of a fresh start that a divorce has the potential to offer, there is often bitterness over the process and the divorce itself that prevents the participants from moving on with their lives. This often, as well, has ongoing, long lasting and damaging effects on children thrust in the middle.
These feelings are often attributed to the spouses' feelings of no control over the process and feeling like they are stuck with a divorce agreement that doesn't meet their expectations or particular needs.
Collaborative divorce gives the spouses direct input into every decision that is made throughout the process. Couples who have been through a collaborative divorce often report being more satisfied with the outcome. In addition, the agreements reached with regard to custody, support and other issues tend to be followed more consistently than those litigated or imposed by the court. Mediation is designed to facilitate a civil negotiated resolution to complex and emotionally trying disputes.
Collaborative Divorce
In a collaborative divorce, both spouses and their collaborative attorneys sit down and work through every aspect of the divorce agreement together. Prior to the start of the process, both parties sign an agreement not to take the matter to court. If an agreement cannot be reached and one or both spouses choose to pursue litigation, both collaborative lawyers would be disqualified from further representation and the spouses would need to obtain new legal representation for litigation. The purpose for this framework is to encourage serious commitment and collaboration by both parties to resolve the matters in dispute jointly.
