Skilled Representation for Support Issues
A large part of every divorce proceeding is concerned with financial issues. When couples are married, the majority of expenses are shared jointly. Once a couple files for divorce and after a divorce is finalized, several types of support may come into play. At the law firm of Nestico, Druby & Hildabrand, P.C., based in Hershey, Pennsylvania, we have helped clients to resolve a variety of complex support issues.
Protecting Your Interests in All Types of Support Cases
Child Support: Child support is determined using specific Pennsylvania guidelines. A judge will take the parents' incomes and several other factors into consideration, including who pays for health insurance and day care, how many overnights the child spends with each parent and others. Child support issues, and modification of existing support orders, are handled through the county Domestic Relations Office. We will help you file the initial support complaint, prepare for the conference and represent you at the support conference. If the matter is appealed, we will represent you in any hearings before the Court.
Spousal Support and Alimony Pendente Lite: Spousal support can be ordered after a married couple has separated and usually continues until the divorce decree is entered. Alimony pendente lite or APL is similar to spousal support but can only be obtained after a divorce complaint has been filed and is intended to provide financial stability during the divorce process. Like child support, spousal support and APL issues are handled through the county Domestic Relations Office. The amount is largely based on the income levels and earning capacities of the spouses. Your lawyer will walk you through the entire process and work to ensure that any award ordered in your case is fair.
Alimony: Alimony is handled as part of the marital or property settlement agreement in the divorce proceeding. It is not obtainable in every case. Its purpose is primarily rehabilitative in nature although some cases may be appropriate for long term alimony. Our attorneys will evaluate the circumstances of your case to determine if alimony is potentially an issue.
